International Forum XXI Century Advertisement Non-Discriminatory Advertising Standards.

International Forum «Advertising of the 21st Century. Standards of Gender Non-Discriminatory Advertising»

 On October 25th, 2018 the International Forum "Advertising of the 21st Century. Standard of Non-Discriminatory Advertising" was held in Kyiv and brought together more than one hundred participants to discuss legal and self-regulatory mechanisms for ensuring implementation of non-discrimination principles in advertising. Advertisers and advertising agencies, professional marketing associations, gender experts, teachers of marketing, as well as representatives of executive authorities came together to learn about European policies and trends in this domain and to discuss proposed amendments to the Law of Ukraine “On Advertising”.

 Justina Raižytė, Development and Policy Manager of European Advertising Standards Alliance (Belgium), and Ella Smillie, Regulatory Policy Executive at the Regulatory Policy Department of the Advertising Standards Authority (United Kingdom) talked on the latest developments in ensuring non-discriminatory marketing and advertising practices by European professional community. The state of arts in Ukraine was described by Iryna Lylyk, President of the Ukrainian Marketing Association and Head of the Industrial Gender Committee on Advertising, and Maksim Lasebnik, Executive Director of the All-Ukrainian Advertising Coalition, who, in particular, focused on application of the Non-Discriminatory Advertising Standard adopted by professional associations and gender NGOs as a tool for ad market self-regulation back in 2011.

 In 2018 the Ministry of Social Policy, in partnership with the Friedrich Ebert Foundation, and the Industrial Gender Committee on Advertising initiated the development of proposals for amendments to the Law on Advertising in order to prevent distribution of discriminatory ads. The working group on amendments included experts from the State Service of Ukraine for Food Safety and Consumer Rights, the State Service for Labor Rights, the National Council for Television and Radio Broadcasting, and representatives of civil society.

 On  July 5th, 2018 the Verkhovna Rada of Ukraine registered the draft Law "Amendments to the Ukrainian Law "On Advertising" on Combating Discrimination" (Reg. No. 8558) filed by People's Deputy of Ukraine Iryna Lutsenko. On October 17th , 2018 the draft law was approved by the Committee on Freedom of Speech and Information Policy of Verkhovna Rada of Ukraine.

 The Forum participants stressed that the fight against discrimination in advertising requires clear definition of discriminatory advertising and increase of fines for violators. Such measures are viewed as efficient means for prevention of negative social consequences of discretionary messages in visual environment, support of controlling executive and judicial bodies and empowerment of citizens to respond to promotion of discriminatory or violent messages in ads.

 The forum was organized by the Ukrainian Marketing Association, the Industrial Gender Committee on Advertising in partnership with the Ministry of Social Policy of Ukraine and Friedrich Ebert Foundation Office in Ukraine.
